Terms of Service for NOC Signatures, the document-focused e-signature tool for U.S. contractors managing Notice of Commencement documents and statutory lien waivers.

The service, and what it is not

NOC Signatures provides software for preparing, sending, and electronically signing construction documents. It is not a law firm and does not provide legal advice. Nothing in the product or on this site is a substitute for advice from a licensed construction attorney about your project, your contract, or your state's requirements.

Eligibility and accounts

You need an account to use most of the service, you must be able to form a binding contract, and you are responsible for activity that happens under your account and for keeping your credentials secure.

Electronic signatures and records

Electronic signatures are enforceable under the federal E-SIGN Act (15 U.S.C. § 7001 et seq.) and, in Florida, the Uniform Electronic Transaction Act (Fla. Stat. § 668.50). Both give an electronic signature the same legal effect as a handwritten one, provided the signer intended to sign and the record is retained in a form that can be accurately reproduced. By using the service you agree to transact electronically and to receive records in electronic form.

Your responsibilities

• You are solely responsible for the accuracy, completeness, and legality of any document you create, send, or sign through the service
• You are responsible for ensuring the Notice of Commencement complies with Florida Statutes Chapter 713 and the requirements of the applicable county
• You are responsible for properly recording the executed Notice of Commencement with the appropriate county clerk and posting it at the jobsite as required by law
• You will not upload content that is unlawful, infringing, fraudulent, or that you do not have the right to share
• You will not attempt to disrupt, reverse engineer, or gain unauthorised access to the service

Fees, termination, and third-party services

Paid features are billed as described at the point of purchase, and parts of the service rely on third-party providers for payments, email delivery, and hosting. Either party may end the relationship; documents you have already signed remain your records.

Disclaimers and limitation of liability

The service is provided as-is, without warranty that any document will be accepted by a particular clerk or will achieve a particular legal result, and liability is limited as set out in the full terms. Recording deadlines, county form preferences, and statutory requirements remain your responsibility.

Governing law and changes

These terms are governed by the law stated in the full agreement, and we will update this page if they change. Continued use after a change means you accept the revised terms.
